(“Powder Laundry”)

TERMS AND CONDITIONS OF ENTRY

We welcome Our Customers and thank you for visiting Powder Laundry’s Premises.

By entering Our Premises, you agree to be bound by these Terms. We reserve the right to vary these Terms by updating this notice, posting it at the entrance of the Premises and on Our Website (www.powderlaundry.com.au).

1. FILMING AND PHOTOGRAPHY

Commercial filming and photography is permitted by prior arrangement only.

The possession or use of video cameras, professional photographic equipment, other visual, sound recording or transmission equipment is absolutely prohibited on Our Premises without Our prior consent.

All filming and photography requests must be sent to wash@powderlaundry.com.au to be considered at Powder Laundry’s discretion in accordance with Our Filming and Photography Terms of Engagement. All approved requests attract a fee. See www.powderlaundry.com.au for Our full Filming and Photography Terms of Engagement.

Failure to obtain prior consent from Powder Laundry for filming and photography in accordance with our Filming and Photography Terms of Engagement will result in a breach of these Terms. If We approve a request, then failure to act in accordance with Powder Laundry’s Filming and Photography Terms also amounts to a breach of these Terms.

2. PROHIBITED CONDUCT

Customers must not do any of the following:

(a) be under the influence of drugs or alcohol;

(b) engage in disorderly, offensive, anti-social, disruptive, unlawful, racial, discriminatory, threatening or other inappropriate behaviour;

(c) smoke inside the Premises;

(d) commit any act of vandalism or littering or damage to property;

(e) make any unlawful recordings of other Customers;

(f) enter inside the machines;

(g) climb on or place items on top of machines.

3. CUSTOMER’S OBLIGATIONS

3.1 Customers must:

(a) use the machines in accordance with their usual conditions of use and any written instructions of use provided on or near to each machine;

(b) place only soft items, including, but not limited to, clothing, doonas, pillows and rugs, inside the machines;

3.2 The Customer acknowledges and agrees that:

(a) it is entering and using the Premises at its own risk;

(b) it is responsible for any damage which it causes to any person or property (including its own property) on the Premises;

(c) any clothing or property left behind will be disposed of/donated by Powder Laundry;

(d) finished, unattended clothing or items may be removed from the machines by other Customers.

4. CCTV SURVEILLANCE

The Premises are fitted with CCTV surveillance for security purposes. Footage collected will not be viewed by or provided to any external body and remains the property of Powder Laundry except where required by law. CCTV surveillance footage will not be held for longer than deemed necessary by Powder Laundry.

5. RISK

Customers acknowledge that they have:

(a) read and understood each of the Risks of Entry described below; and

(b) accepted all of the Risks of Entry and voluntarily assumed all of the risks in attending the Premises whether or not described in these Terms.

Risks of Entry

The risks of entering the Premises include (but are not limited to):

(a) loss or theft of clothing and personal items brought into the Premises;

(b) damage to clothing or property resulting from use of the machines;

(c) slipping on the floors of the Premises because they are wet or have other objects lying on them.

6. EXCLUSION OF LIABILITY & INDEMNITY

6.1 To the fullest extent permitted by law, Powder Laundry and its Associated Persons are not liable for any Loss or Claims suffered or incurred by the Customer arising out of or in any way connected with the Customer’s entry onto the Premises, the Customer’s use of the Premises and the Customer’s use of facilities on the Premises except to the extent that such Loss or Claim is caused by Powder Laundry’s negligent act, omission or default.

6.2 The Customer indemnified and keeps indemnified Powder Laundry and its Associated Persons against all Loss and Claims suffered or incurred by Powder Laundry and its Associated Persons arising out of or in connection with:

(a) any of the Customer’s acts or omissions while on the Premises; and

(b) a breach by the Customer of these Terms; except to the extent that such Loss or Claim is caused by Powder Laundry’s negligent act, omission or default.

7. BREACH

(a) If the Customer breaches these Terms, the Customer may be:

(i) refused entry to the Premises;

(ii) removed from the Premises; or

(iii) reported to the appropriate law enforcement body.

(b) Clause 7(a) does not limit the rights available to Powder Laundry under these Terms or otherwise at law.

8. GOVERNING LAW

The governing law of these Terms is the law of the state of Victoria (Jurisdiction). You irrevocably and unconditionally consent and submit to the Jurisdiction of the courts of the Jurisdiction and waive any right to object to the exercise of such Jurisdiction.

9. SEVERANCE

If any provision of these Terms is judged invalid or unenforceable for any reason whatsoever by a court of competent jurisdiction, such invalidity or unenforceability (unless deletion of such provision would materially adversely affect one of the parties) will not affect the operation or interpretation of any other provision of these Terms to the intent that the invalid or unenforceable provision will be treated as severed from these Terms.

10. DEFINITIONS

Associated Persons means any Related Bodies Corporate of Powder Laundry, the land owner of the Premises, lessees and occupiers of the Premises and Powder Laundry’s respective representatives, officers, employees and agents.

Claim means and includes any Loss, claim, action, proceeding, legal fees or demand made against a person however arising.

Customer(s) means any person entering the Premises, regardless of whether they are paying customers or make use of Powder Laundry’s services and facilities.

Filming and Photography Terms of Engagement means the terms governing use of the Premises for filming or photography.

Loss/Losses means and includes any injury, loss of life, damage, property damage or loss, cost, financial loss, loss of income or other forms of economic loss, expense or liability incurred or sustained by a person (either directly or indirectly) however arising and whether present or future, fixed or unascertained, actual or contingent, special or consequential.

Powder Laundry/We/Our means Powder Laundry Pty Ltd ACN 152 129 470 as trustee for M P Irymple Trust.

Premises means the Powder Laundry stores located at:

(a) 1/2 Ebden Avenue, Black Rock, VIC 3193

(b) 1/50 Albert Street, Brunswick East, VIC 3057;

(c) 1/82 Cheltenham Road, Dandenong, VIC 3175;

(d) 334 High Street, Northcote, VIC 3070.

Related Bodies Corporate has the meaning given by section 50 of the Corporations Act 2001 (Cth).

Terms means these Terms and Conditions of Entry as amended from time to time and posted at the entrance to the Premises or on Our Website (www.powderlaundry.com.au).

You means each Customer.
